BAM’S WEBSITE BUILDER

Service Terms

Know what is included, how your project is approved, and what to expect before you pay.

Effective: October 10, 2026 • Version 1

Your written project agreement

These standard terms are effective October 10, 2026 (Version 1) for new quotes that include them and are accepted by both parties. Your completed quote identifies the client, service provider, scope, price, target dates, payment option, outside costs, and these terms. Any variation must be expressly identified and accepted in writing before payment. Existing agreements keep their accepted terms; this publication does not change them retroactively.

1. Packages and estimated delivery

Starting prices in US dollars. Delivery estimates begin after acceptance, first payment, and required materials.
PackageCurrent starting pricePage allowanceEstimated deliveryRevision rounds
Starter$250Up to 3 pages2–3 weeks2
Business$500Up to 6 pages3–4 weeks2
Premium$850Up to 10 pages4–6 weeks3

Prices are starting prices, not automatic quotes for every website. The quote must list the pages, features, language versions, integrations, content responsibilities, and deliverables included. Online stores, custom accounts, payment processing, copywriting, and other extras are included only when listed.

The delivery window begins after written acceptance, the required first payment, and receipt of all necessary content and access. These are estimates; the quote supplies the target dates. Client delays, approved scope changes, or outside-provider issues may change the schedule. BAM will explain any revised target in writing.

2. Revisions and client feedback

One revision round means one consolidated list of requested changes to the presented work within the accepted scope. The allowance covers design and content adjustments; additional pages, new features, a new design direction after approval, or work beyond the allowance require a separate price and written approval before work begins. Correcting BAM’s errors does not use a revision round.

The client should supply feedback or approval within 5 business days. After 14 calendar days without required materials or feedback, BAM may pause the project after a written reminder allowing 7 additional calendar days to respond. Restart dates depend on availability and will be confirmed in writing. A pause does not automatically create a fee or cancel the project.

3. Payment options

One-time project: 50% of the accepted project price is paid before work starts, and 50% after the client approves the completed preview and before public launch or final handover. The initial payment is credited toward the project price and is subject to the cancellation calculation below; it is not automatically nonrefundable.

Existing installment option: 12 monthly payments of $20.83 for Starter (total $249.96), $41.67 for Business (total $500.04), or $70.83 for Premium (total $849.96). The quote must identify the selected amount, first payment date, subsequent due dates, and any approved extras or applicable taxes. No additional 50% deposit applies to this option unless a different arrangement is explicitly accepted. These installments pay for the website project; they are separate from maintenance.

A completed website may launch before all installments are paid if the account is current and the client has approved launch. The client may use the delivered custom work while payments remain current; ownership transfer follows full payment as described below. A missed payment receives written notice and 7 calendar days to resolve it before BAM pauses further work or separately provided services. Client-owned domains and original content remain the client’s property. Any account-access or hosting arrangement must be expressly disclosed in the quote.

4. Ownership and handover

The client retains ownership of the content, logos, photographs, and other materials they provide. After the full accepted project price and approved extras are paid, BAM transfers ownership of the custom work created specifically for the project and provides the files and account access listed in the quote. On installment projects, that transfer normally occurs after the final installment.

BAM retains ownership of its pre-existing tools and reusable components, granting the client permission to use those components as part of the delivered website. Third-party software, fonts, stock media, and services remain subject to their own licenses; the quote must identify any restrictions or continuing costs. Client domain and hosting accounts should be registered in the client’s name, with BAM given only the access needed for the work.

5. Hosting, domains, and outside costs

Domain registration, hosting, business email, paid software, and outside subscriptions are excluded from the website build price unless itemized in the quote. Before purchase, the quote must state the provider, cost, billing frequency, renewal responsibility, account owner, and whether the client pays the provider directly or reimburses BAM. No outside purchase or recurring charge may be added without the client’s written approval. Third-party renewal rates can change and must not be represented as a permanent fixed price.

6. Launch and support

BAM supplies a preview for written approval before launch. For 14 calendar days after launch, BAM corrects at no additional charge reproducible defects in its delivered work that prevent the agreed features from functioning. New requests, client changes, and issues caused by outside-provider changes require a separate agreement. This support window does not replace any rights that apply by law.

Optional maintenance: $50 per month for up to 60 minutes of minor text, image, and link updates, with an initial response within 2 business days. Unused time expires at the end of the billing period. New pages, redesigns, new features, hosting, paid tools, emergency support, and work beyond the allowance require a separate approved quote. A response is an acknowledgment and plan, not a promise to complete every request within 2 days.

Maintenance requires a separate opt-in agreement. Cancellation requests received before the next renewal stop that renewal; service remains available through the paid period. A renewal that has already started is not ordinarily prorated unless BAM fails to provide the agreed service or applicable law requires otherwise. BAM will confirm the service end date in writing.

7. Project cancellation and refunds

Either party may cancel the project by written notice. Clients can email bamswebsitebuilder@gmail.com, identifying their quote number. Stopping automatic payments alone is not a project cancellation request; BAM will confirm receipt and provide a final accounting.

Standard milestone values are: planning and scope 10%, design 30%, website build 40%, and testing and launch 20% of the accepted project price. The quote must define the deliverable and approval evidence for each milestone. Completed, client-approved milestones are earned; an incomplete milestone is not charged under these standard terms. A different progress-payment method applies only if specified and accepted in the quote before work.

On cancellation, the amount earned equals completed, client-approved milestones plus separately authorized, nonrecoverable outside costs, without double counting costs included in the project price. Milestone charges cannot exceed the accepted project price. Payments already made are credited against that amount. An overpayment is refunded; an unpaid earned balance is due within 10 business days after the itemized accounting. Charges for unperformed future work are not automatically due, including remaining installments.

If no work has been completed and approved, the project payment is refunded except for separately authorized, nonrecoverable outside costs. BAM will initiate any refund to the original payment method within 10 business days after issuing the final accounting; the payment provider’s processing time is additional. BAM returns the client’s original materials and, after any earned balance is paid, supplies usable files for paid, completed milestones. If BAM cancels, the same accounting and handover rules apply. Applicable consumer rights remain in effect.

8. Content, privacy, and portfolio permission

The client confirms that they have permission to use the materials they supply and is responsible for reviewing business claims and final content. BAM uses client materials and access only to complete the agreed work and protects confidential information. Passwords should be shared through an agreed secure method.

Featuring a client’s project, name, logo, or testimonial requires separate written permission identifying what may be published. Project acceptance alone does not give that permission. Testimonials must reflect the client’s actual words and may not be invented.

9. Acceptance record before payment

Every client receives a completed quote and a retainable copy of these terms with a quote number, issue date, and version. Quotes are valid for 14 calendar days unless stated otherwise. Any later price or scope change requires a new written agreement.

The client can sign the completed agreement or reply from their identified email address: “I have reviewed and accept Quote [number], dated [date], including Project Terms [version/date], for [project], at [total price] under the [payment schedule]. I approve the stated scope, delivery estimate, revision allowance, ownership and handover terms, outside costs, and cancellation terms.”

BAM confirms its acceptance in writing and retains the completed quote, terms, client acceptance, and confirmation in the project record. Payment instructions follow that acceptance. You will receive a copy of the accepted agreement for your records.
